Tie the knot with confidence

A WARRINGTON law firm is advising couples that they can “tie the knot” with confidence following a ruling on prenuptial agreements.
“Prenups,” which lay out who should get what in the event of a later divorce, have only been advisory until now, but are considered more binding following a Supreme Court ruling
A recent test case involving German heiress Katrin Radmacher and her French ex-husband Nicolas Granatino has created a new presumption in favour of prenuptial contracts, in line with the rest of Europe.
This means couples freely entering such agreement at the start of their marriage are likely to have it upheld in the divorce courts, unless it was later argued to be unfair.
Forshaws Davies Ridgway (FDR) LLP welcomes the interpretation of the law as good news for any couple concerned about entering into a marriage where one partner is wealthier than the other.
Audrey Venables, head of family law, said: “This ruling is likely to provide peace of mind for many local couples, particularly people about to enter second marriages, where they may have built up considerable assets. And this doesn’t have to be a fortune. It may just be clarification of a house or flat ownership.
“It is reported that Ms Radmacher and Mr Granatino entered into this agreement because they were keen to show they were marrying for love not money. Preparing a prenuptial agreement is not unromantic, but many people are realistic about the future and the existence of this document can make a massive difference to the outcome of any later divorce settlement.”
