It’s that time of the year where as a business owner or employer, you take a good, hard look at your company with a fresh perspective coming into the New Year in the hopes that you can make productive and positive changes which will benefit the business.

A large part of our job as an outsourced HR company is to keep you up to date with and put the foundations in place for any upcoming employment legislation or tribunal precedents. So what is coming up in April 2020 that you need to be aware of?

• New legislation as part of the ‘Good Work Plan’ introduces the entitlement to receive a statement of ‘written particulars’ (employment contract) to include workers as well as employees and make it a day one right. Currently employers have up to two months to issue the statement to any employee working for them for more than a month.
• ‘Swedish derogation’ covered in the Agency Worker Regulations will be abolished. Swedish Derogation allowed agencies to opt out of equalising the pay of agency staff with the permanent workforce when they had been with the same employer for more than 12 weeks, provided they paid the agency workers between assignments.
• The IR35 tax rules are to be extended to the private sector. The rules are aimed at reducing tax avoidance for off-payroll contractors working through personal service companies (PSC). The new rules will also apply to private sector businesses with an annual turnover of over £10.2 million or 50 or more employees.
