Warrington-based second-hand car sale company Max Car Sales Ltd entered guilty pleas to misleading sales practices at Warrington Magistrates Court, following a trading standards investigation.
The investigation uncovered what the judge described as “practices that fell well below the standard expected of a reasonably competent tradesperson” in the sale of second-hand vehicles.
The company offered guilty pleas to four offences of misleading actions and three offences of breaching the requirements of professional diligence under Consumer Protection from Unfair Trading Regulations 2008 relating to the sale of five different second-hand cars.
The investigation revealed that customers were misled about the cars, were sold poor vehicles, in one case sold a diesel car instead of a petrol car and the company dealt very poorly with customer refunds.
The company based on Gorsey Lane, Warrington, was fined £10,000 with an additional £2,000 in victim surcharge with £4,700 awarded in compensation to consumers adversely affected and a £2,515 toward prosecution costs, a total of £19,215.
Cllr John Kerr-Brown, cabinet member for housing services and licensing, said: “This case shows very clearly the harm that dishonest business practices can inflict on ordinary people. The victims suffered financial loss, emotional distress and frustration simply trying to resolve problems.”
