Council to introduce parking ban on roads around Walton Hall and Appleton Reservoir

WARRINGTON Borough Council is set to introduce a temporary parking ban on roads surrounding Walton Hall and Appleton Reservoir to address the potential of large numbers of visitors as lockdown restrictions are lifted.

The Council intends to make an Order under Section 14 of the Road Traffic Regulation Act 1984. The effect of which will be to introduce a 24 Hour Clearway, prohibiting Motor Vehicles from stopping or remaining at rest at any time, on the lengths of road specified.
The order will be effective from 26th March 2021 for a maximum period of 18 months and will be effective as and when indicated by traffic signs on site.
The Order will supersede any contravening orders.
The council say the restrictions are required as part of the proposed relaxation in lockdown entering the summer months to address potential large numbers of visitors in relation to COVID-19 pandemic response and recovery measures.
SCHEDULE
Firs Lane – Entire length.
Hough’s Lane – Entire length.
Park Lane -Entire length.
Walton Lea Road – Entire length.
Warrington Road From its junction with Old Chester Road in a southerly direction to a point approximately 145 metres south east of its junction with Park Lane.
Whitefield Road From its junction with Walton Lea Road to its junction with Old Hall Close.

  1. Section 14 of the RTRA applies in the following circumstances:
    14Temporary prohibition or restriction on roads.
    (1)If the traffic authority for a road are satisfied that traffic on the road should be restricted or prohibited—
    (a)because works are being or are proposed to be executed on or near the road; or
    (b)because of the likelihood of danger to the public, or of serious damage to the road, which is not attributable to such works; or
    (c)for the purpose of enabling the duty imposed by section 89(1)(a) or (2) of theEnvironmental Protection Act 1990 (litter clearing and cleaning) to be discharged,the authority may by order restrict or prohibit temporarily the use of that road, or of any part of it, by vehicles, or vehicles of any class, or by pedestrians, to such extent and subject to such conditions or exceptions as they may consider necessary.

    Either they do not mean what they said or they are acting unlawfully. Stopping restrictions are not covered by that section!
