THE Gross Misconduct Hearing concerning Cheshire’s Police Chief Constable Simon Byrne will be heard in public in Warrington this April.
The hearing will take place at Warrington Town Hall stareting at 10am 16 April to 27 April 2018 (excluding 21 & 22 April 2018).
The hearing will start 10am on 16 April and 9.30am thereafter.
The allegations involving the police chief who was suspended last August, state that “Being a police officer with Cheshire Constabulary, between May 2014 and March 2017 you breached the Standards of Professional Behaviour set out in Schedule 2 to the Police (Conduct) Regulations 2012 in respect of ‘Authority, Respect and Courtesy and ‘Discreditable Conduct’ as follows:
“You lacked self-control and exhibited volatile, unpredictable and offensive behaviour. You displayed a short temper and a lack of tolerance and engaged in angry outbursts and aggressive attacks upon subordinate staff which created an intimidating, hostile and humiliating environment for staff in the ‘ACPO office’ and which you knew or ought to have known would cause distress and anxiety to members of Cheshire Constabulary.
At the time of the suspension Warrington-based Cheshire Police and Crime Commissioner, David Keane, said: “Following allegations made in late 2016 against Chief Constable Simon Byrne and following advice from the IPCC, a local investigation conducted by an external police force has been underway in accordance with the statutory police conduct regime.
“Following receipt of the Investigation Report, and having carefully considered the evidence, I have determined that there is a case to answer for gross misconduct with regards to Authority, Respect and Courtesy and Discreditable Conduct.
“This matter must now be referred to an independently chaired gross misconduct hearing.
“In light of this determination, I consider that the public interest requires that Mr Byrne be suspended pending the conclusion of the hearing. Deputy Chief Constable McCormick will be undertaking the role of Acting Chief Constable.
“I will not be making any further comment on the matter at this time in order to preserve the integrity of the on-going process.”
