Eyesore tyre wall row set to rumble on into New Year

AN unsightly wall of tyres on land near Kingsway Bridge, Warrington, is set to remain in place well into the New Year!
Landowner Patrick Moran, of Glazebrook Lane, Warrington, has lodged an appeal against an order by Warrington magistrates to remove the controversial tyre wall and a crown court hearing has been adjourned until next February.
Warrington Borough Council took action against Mr Moran to remove the wall of tyres from the land at the junction of Farrell Street and Kingsway North.
But during a court hearing earlier this year Mr Moran claimed he had a right to construct the tyre wall saying he had the permission of the Environment Agency who are working on adjoining land.
As planning permission was already in place on the land for work by the Environment Agency, Mr Moran said he could erect a hoarding fence around the perimeter of the site to prevent access to the building work.
A council spokesperson said: “Earlier this year a section 215 notice was served on the land owner requiring the tyre bales to be removed from the site.
“The land owner appealed the notice to the Magistrates Court and the case was heard on 21st May 2014. The Magistrates Court found in favour of the council and upheld the section 215 notice and the owner was ordered to pay the sum of £1,600 to the council, in terms of costs, and to remove the tyres.
“The land owner has now appealed the Magistrates Court decision to the Crown Court. This was due to take place on 21st November but it was postponed by the Court until February 6, due to other urgent cases.
“The council cannot legally enforce the notice until the matter has been determined by the Crown Court.
“The council is also taking further court action against the landowner in relation to the display of unauthorised advertisements at the site.”
The tyre wall appeared in January of this year.
