Living in Warrington? why your US tax return may get more complicated

For Americans settling in Warrington, finding a home and starting work may take priority over US paperwork. However, moving to Cheshire does not automatically end your American tax responsibilities, even when your employer deducts UK tax from every payslip.

Consider Sarah, a fictional American who moves from Texas to Warrington for a job. Previously, she worked for one employer, received a W-2 and kept her savings in US accounts.

Her new life still looks straightforward: a UK salary, two bank accounts and occasional freelance work. Yet filing US taxes from abroad now involves overlapping rules that were never part of her old routine.

A UK salary can belong on a US tax return

US citizens generally remain subject to US tax on worldwide income, with filing requirements depending on income, filing status and other circumstances.

Sarah’s employer deducts UK income tax through PAYE. That handles payroll withholding, but it does not settle her American filing obligations.

She may qualify for the Foreign Tax Credit or Foreign Earned Income Exclusion to reduce US income tax. Neither automatically removes the need to file.

The distinction matters: owing no additional US income tax is different from having nothing to report.

The UK and US follow different tax calendars

The UK tax year runs from 6 April to 5 April, while most US individual returns cover the calendar year.

Sarah therefore cannot simply copy the annual figures from her P60 into her US return. She needs records that identify income for January through December.

Keeping monthly payslips, bank statements and details of UK tax paid helps reconcile those periods. Her US return also requires dollar amounts, making appropriate currency conversion another part of the preparation.

Ordinary UK accounts can create extra reporting

A current account for bills and a savings account for emergencies can trigger US reporting requirements.

An FBAR is generally required when the combined value of reportable foreign financial accounts exceeds US$10,000 at any point during the calendar year. The threshold applies collectively, rather than separately to each account.

Form 8938 is a different requirement, with separate thresholds and rules. Some taxpayers need both.

For Sarah, this means bank balances deserve attention even when the accounts generate little interest.

Freelance work needs its own review

A weekend project can introduce obligations beyond those associated with employment.

Suppose Sarah designs presentations for American clients from her Warrington home. Their location does not automatically make the work equivalent to employment performed in America.

She should keep separate records of receipts and expenses and check her UK and US obligations. The Foreign Earned Income Exclusion does not itself reduce US self-employment tax. However, the US-UK social security agreement may provide an exemption where UK coverage applies, supported by the appropriate certificate.

What if you have missed US tax returns?

Eligible Americans abroad may catch up through the Streamlined Foreign Offshore Procedures, often called the Streamlined Tax Amnesty Program.

The IRS streamlined rules for taxpayers abroad require non-willful failures, such as mistakes or good-faith misunderstandings.

For US citizens, the residence test generally requires no US abode and at least 330 full days outside the US during at least one of the three relevant tax years. Both spouses must qualify for a joint submission.

A qualifying submission generally includes:

  • Three relevant years of overdue or amended returns, with required information forms.
  • Six relevant years of missing FBARs, where required.
  • Form 14653 explaining and certifying non-willful conduct.
  • Payment of outstanding tax and interest.

Eligible submissions receive specified penalty relief, but tax and interest remain payable. An existing IRS civil examination or criminal investigation can prevent eligibility.

Start with records and a review of your filing history

Before submitting overdue returns, identify what was required and which correction route applies.

Gather previous returns, UK income records, account statements and any IRS correspondence. Explain when you moved abroad, what you understood about filing and when you discovered the gap.

For Americans building a life in Warrington, an annual recordkeeping routine can make future filing more manageable. Checking both countries’ requirements early also gives you time to resolve questions before deadlines arrive.
