Sex attacker who visited victim in hospital after she attempted suicide jailed

A Warrington woman was so distressed by a sex assault on her that she tried to kill herself with a drugs overdose and ended up in hospital, a court heard.

And while she was under sedation her attacker, Johnathan Rutter, aged 45, had the nerve to visit her and stole her bank card and used it to obtain £80 cash.

“That was a despicable offence and added insult to injury to a woman who had been humiliated by your conduct that day. It was deliberate and it was shocking,” said Recorder Peter Wright, KC.

Frank Dillon, prosecuting, told Liverpool Crown Court that the incidents took place on October 28 last year. The sex assault took place in the victim’s own home in front of friends while Rutter was drunk.

He called her abusive names and then pulled down his shorts and put his penis by her face and told her “get this in your gob.”
Rutter became aggressive but left the property shortly afterwards. The woman was so distressed she took 100 tablets and self-harmed with a razor blade.
Mr Dillon said that she was taken to hospital for treatment and while there under sedation Rutter turned up and stole her bank card which he then used to obtain £80 cash.

She was later discharged from hospital and he rang her saying he had £80 for her. She contacted the police and he was arrested.
In an impact statement she told how badly she had been affected by his behaviour and said she wanted the courts to protect her from him.
Carmel Wilde, defending, said that 45-year-old Rutter, who has committed 23 previous offences, was “embarrassed and had expressed shame” about his behaviour.

The complainant had been subjected to the assault in front of others and he “wished to apologise and recognised what a terrible incident it must have been for her.”
He has mental health issues and had not been taking his anti-psychotic medication at the time and had been drinking heavily, she explained.

Miss Wilde added that Rutter had been in hospital himself after a hammer attack for which his assailant is being prosecuted.
Rutter, of Orpington Road, Eastfield Green, Cramlington, Northumberland, pleaded guilty to sexual assault, theft and breaching a restraining order.

Sentencing Rutter to 34 months imprisonment, the judge said he accepted, “You are a man with mental health fragility and you have expressed remorse for your behaviour.”
He imposed a five year restraining order to keep away from the victim.
