Divorce – a landmark change coming soon

Ever since the case of Owens v Owens there has been a strong amount of challenges brought by both clients and professionals to the fact that currently there is not a “no fault” divorce in England and Wales.

However, with changes to the law, under the Divorce, Dissolution and Separation Act 2020, from April 2022, the no-fault divorce will become a reality.



The new divorce process removes the element of blame. It is hoped that by doing this it will help parties to reach more amicable arrangements when it comes to deciding the matrimonial finances and children matters. It also removes the ability for one party to defend a divorce, which again helps to reduce the acrimony between parties in the divorce process. This hopefully should help to speed the process up, which currently in many cases can take more than six months.
Other important changes brought in by the Divorce, Dissolution and Separation Act 2020 will introduce a further option of parties being able to bring an application together.
