Approval given for two-bed end terrace at Padgate to be converted into five-bed HMO

PLANNERS have authroised the use of a two-bedroom end-terraced property at Padgate to bew used as a five-bed House in Multiple Occupation (HMO).

The application for a certificate of lawfulness relates to a property on Valiant Close, Poulton-with-fearnhead, Padgate and involves proposed Change of use from a residential dwelling (C3) to a 5-bed HMO (C4) and internal alterations.
Two public representations were received both raising objections to the proposed HMO. In summary, the following points:

The area is already overcrowded.
The HMO will attract anti-social behaviour.
Fears for children’s safety are raised.
The number of occupants will add to parking pressures within the locality.
Work has already been carried out on the
property.

Planners say the concerns raised in the public representations are acknowledged, however, an application for a lawful development certificate can only assess whether the proposed use of buildings or land would
be lawful for planning purposes under section 192 of the Town and Country Planning Act 1990. Views expressed in relation to the planning merits of the proposed development cannot be considered in determining the application.
One representation advised that works had already been carried out on the site. The application advises that no external works to the property are proposed, only internal alterations to the layout of the property.
The proposed change of use to provide a small HMO would comply with the criteria of permitted development as defined under Schedule 2, Part 3, Class L.
It is therefore recommended that a Lawful Development Certificate for the proposed development is approved.
